Examples from our Bank Litigation Practice:

We obtained a defense verdict for a large national bank in a federal court jury trial in which plaintiff asserted claims of misrepresentation and sought over one million dollars in damages.

In another matter, we successfully defended a lender in a suit brought by borrowers who sought rescission of a mortgage loan transaction pursuant to the Federal Truth in Lending Act.

Bank Fraud Attorneys

The Firm represents some of the nation's largest banks as well as several regional financial institutions in numerous bank operations claims, check fraud and wire transfer fraud cases.

In one such recent case, we were successful in representing a large bank in pursuing claims for losses that it had incurred in connection with a multi-state check fraud scheme.

Bank Operations Attorneys

The Firm has counseled numerous financial institutions in connection with operational matters. Our expertise includes negotiating and drafting software purchase agreements, service provider agreements, and customer agreements for banks. For example, we worked extensively with a Massachusetts bank to review, revise, and strengthen its Positive Pay service agreement. We have worked with another local bank to revise its Remote Deposit Capture services agreement as well as its ACH services agreement. We also negotiated and documented leases for the installation of ATM machines in 50 convenience store locations. We have advised another Boston-based financial institution in connection with a number of its outside vendor agreements, including contracts covering item processing and disaster recovery computer services. 

We have also successfully defended banks in "public accommodation" discrimination claims.

Collections Attorneys

We have represented creditors in hundreds of matters and have recovered millions of dollars in assets for our clients by employing sophisticated investigative and legal tactics. Sally & Fitch LLP was one of the largest providers of litigation services to the FDIC as it concluded the collection and workout of loans made by over fifty failed banking institutions. Today we handle these cases mainly for lease and loan servicers and opportunity funds, as well as for banking institutions.
